Matters appearing on the Consent Calendar are expected to be non-controversial and will be acted upon by the City Council at one time, without discussion, unless a Councilmember or the Administration requests an opportunity to address any given item. Items removed from the Consent Calendar will be discussed at the beginning of the Formal Items. Approval by the City Council of Consent Items means that the recommendation of the Administration is approved along with the terms and conditions described in the Administrative Report.

Minutes

Approve the minutes of the special and regular meetings of March 21, 2011, and the special meeting of March 24, 2011.

2.
City Council Meeting Schedule (40)

a.
Cancel the special joint meeting of the City Council and the Ventura Port District Board of Port Commissioners on Thursday, April 14, 2011.

b.
Cancel the regular meeting of the City Council on Monday, April 18, 2011, and reschedule a special meeting on Tuesday, April 19, 2011.

c.
Cancel the special joint meeting of the City Council and the Parks and Recreation Commission on Thursday, May 5, 2011, to be rescheduled on a date to be determined.

d.
Cancel the special joint meeting of the City Council and the Library Advisory Commission on June 9, 2011, and reschedule on Thursday, June 16, 2011.

Surfers Point  Managed Shoreline Retreat Project Construction Contract Change Order  (35)

a.
Authorize the Mayor to approve the contract change order for the Surfers Point Shoreline Managed Retreat Project, Specification No. 2008 -16 to the construction contract with C.A. Rasmussen Inc., in the amount of $278,790.48.

b.
Increase appropriations and encumber funds from the General Fund Capital Project Bonds (RDA 2008 TAB) to the Surfers Point Managed Shoreline Retreat Project (Program 93959) in the amount of $398,025 and authorize the Finance and Technology Department to record the changes to the proper funds, projects, and accounts.

4.
Lifeguard Services with the State of California Department of Parks and Recreation (76)

Authorize the City Manager to execute an agreement with the State of California for lifeguard services at the Ventura Pier City Beach and adjacent to Marina Park for a three-year term with two one-year extensions based on approval of both parties, for a total three year amount of $150,000 at $50,000 per year.

Lowe’s Center Parcel 4 Quitclaim Deed (50)

(REQUIRES AT LEAST FIVE AFFIRMATIVE VOTES) Authorize the City Manager to sign the quitclaim deed releasing and quitclaiming Parcel No. 4 of Parcel Map LD 855.

Community Access Partners of San Buenaventura, Inc. (50)

Authorize the Mayor to execute an agreement with Community Access Partners of San Buenaventura (CAPS) to be in effect for a term of five years beginning May 1, 2011 through June 30, 2016.

Solicitation Ordinance Amendment (70)

a.
Introduce and waive the first reading of an ordinance amending Municipal Code Section 10.100.020 relating to unlawful places for solicitation.

b.
Set the proposed ordinance for a second reading and adoption at the City Council meeting of May 2, 2011.

Adopt a resolution sustaining the revocation of the Alcoholic Beverage Establishment Deemed Approved status of National Convenience Stores, Inc., dba Circle K, located at 3506 East Main Street, Ventura.


a.
Introduce and waive the first reading of an ordinance amending Title 24 of the Municipal Code to create a new use type and definition for "Personal Services:  Restricted" and to amend the C -1 Limited Commercial, C -1A Intermediate Commercial, C -2 General Commercial, and C -P -D Commercial Planned Development Zones to permit  "Personal Services:  Restricted."

b.
Set the proposed ordinance for a second reading and adoption at the City Council meeting of May 2, 2011.

Conduct a public meeting and receive public testimony.

11.

Authorize staff to proceed with negotiations with Solar Power Partners (SPP), Inc., for the Solar Power Purchase Program for City Hall, Specification No. 2010-037 and finalize a power purchase agreement and accompanying site lease agreement.
