CITY COUNCIL CONSENT ITEMS
 
Matters appearing on the Consent Calendar are expected to be non-controversial and will be acted upon by the City Council at one time, without discussion, unless a Councilmember or the Administration requests an opportunity to address any given item.  Items removed from the Consent Calendar will be discussed at the beginning of the Formal Items.  Approval by the City Council of Consent Items means that the recommendation of the Administration is approved along with the terms and conditions described in the Administrative Report.

Minutes

Approve the minutes of the special and regular meetings of September 28, 2009.

2.
Use of City Pier (70)

Waive the second reading in full and adopt an ordinance amending Division 10 of the Municipal Code entitled, "Public Peace and Morals Regulations," by adding a new Chapter 10.230 entitled, "Use of City Pier," to regulate behavior occurring on and around the pier.

Cultural Affairs Commission and Library Advisory Commission Quorum Requirement (30/70)

a.
Introduce and waive the first reading of an ordinance amending Section 2.410.210 of the Municipal Code temporarily modifying the quorum requirement to a majority of the existing members for the Cultural Affairs Commission and the Library Advisory Commission to be in effect through April 2010.

b.
Set the proposed ordinance for second reading and adoption at the City Council meeting of October 19, 2009.

4.
Easement for Use of a Portion of City’s Linear Park (50)

Authorize the City Manager to execute an easement agreement with Royal Street Communications California, LLC, to use a portion of the City's linear park to access their cellular transmission facilities on property located in an unincorporated area bounded by the Santa Clara River, Johnson Drive, and Highway 101.

CITY COUNCIL PUBLIC HEARING CONSENT ITEM

a.
Introduce and waive the first reading of an ordinance approving a Change of Zone from General Industrial (M -2) to Mixed Use Development (MXD).

b.
Approve the Mitigated Negative Declaration.

c.
Set the proposed ordinance for second reading and adoption at the City Council meeting of October 19, 2009.
