REPORTS - REGIONAL BOARDS/COMMISSIONS/COMMITTEES
 
This time is set aside to allow Councilmembers serving on regional boards, commissions, or committees to present a verbal report to the full City Council on the activities of the respective boards, commissions, or committees upon which they serve.

PUBLIC COMMUNICATIONS
 
At the first regular meeting of the month, the City Council has allocated a total of 30 minutes for members of the public to address the City Council on items of City business other than scheduled agenda items.  Each speaker is limited to a cumulative total of five minutes for all presentations during this meeting.  Should there be more than six speakers, the City Council has discretion to limit the time for each speaker. Persons wishing to address the City Council should complete a green "Speaker Form."

CITY COUNCIL CONSENT ITEMS
 
Matters appearing on the Consent Calendar are expected to be non-controversial and will be acted upon by the City Council at one time, without discussion, unless a Councilmember or the Administration requests an opportunity to address any given item.  Items removed from the Consent Calendar will be discussed at the beginning of the Formal Items.  Approval by the City Council of Consent Items means that the recommendation of the Administration is approved along with the terms and conditions described in the Administrative Report.

Minutes

RECOMMENDATION Approve the minutes of the special meeting of May 31, 2007.


2.
City Council Administrative Items (40) 

RECOMMENDATION Receive and file these reports:

a.
The July 2007 Status Report of the projects referred to staff by a majority vote of the City Council.

b.
The current Planning Calendar for future major City and Redevelopment Agency agenda items.


3.

RECOMMENDATION Approve the attached employment agreement fixing the terms and conditions of employment for appointment of Ariel Pierre Calonne as City Attorney.


4.
Preserve America Community (40)

RECOMMENDATION Adopt the Preserve America resolution, demonstrating the commitment to the preservation of the City of Ventura's heritage assets, as part of the Preserve America Community Designation process.


5.
Fiscal Year 2007 -2008 Transportation Development Act Funds  and  Ventura Intercity Service Transit Authority (VISTA) 101 and VISTA 126 Agreement Addendums (50) 

RECOMMENDATION

a.
Adopt a resolution authorizing the City Manager to file an application with the Ventura County Transportation Commission (VCTC) for Transportation Development Act (TDA) funds for Fiscal Year 2007 -2008.

b.
Approve the Cooperative Agreement Addendum with the Cities of Camarillo, Oxnard, Thousand Oaks, the County of Ventura, and the VCTC for the VISTA Highway 101 Route, and authorize the City Manager to execute the agreement on the City’s behalf.

c.
Approve the Cooperative Agreement Addendum with the Cities of Fillmore, Santa Paula, the County of Ventura, and the VCTC for the VISTA Highway 126 Route, and authorize the City Manager to execute the agreement on the City’s behalf.


6.
Highway 126 Interchange Landscape Improvements (50) 

RECOMMENDATION Approve a Cooperative Agreement with the State Department of Transportation (Caltrans).


7.
Federal Justice Assistance Grant Program (31)

RECOMMENDATION

a.
Approve the filing of a grant application for $28,982 under the Federal Fiscal Year 2007 Justice Assistance Grant (JAG) Program with the U.S. Department of Justice.

b.
Authorize the City Manager or designee as agent for the City to conduct all negotiations and execute and submit all documents, including without limitation applications, agreements, and billing statements that may be necessary to accept the grant and complete the project.

c.
Authorize Finance and Technology Department to assign the increased appropriations and revenues to the General Grant and Categorical Fund, Police Department budget once the grant is received, within the Program Justice Assistance Grant, in the amount of $28,982.

505 Poli Street (50)

RECOMMENDATION (Requires at least five affirmative votes)

a.
Authorize the City Manager to execute a Lease Agreement with Motive Interactive for City property located at 505 Poli Street -4th Floor.

b.
Authorize Finance and Technology Department to establish annual revenue and expenditure appropriations in the appropriate accounts to reflect this activity. QUASI -JUDICIAL PROCEEDINGS Ex Parte Communications:  An ex parte communication is a communication made with a Councilmember outside the Council Chambers with any person except the City Attorney concerning a quasi -judicial proceeding to be heard by the City Council.  When a Councilmember has an ex parte communication concerning a subject that is the basis of a quasi -judicial proceeding, the Councilmember must: (a) state for the public record the nature of that communication, (b) with whom the ex parte communication was made, and (c) a brief statement as to the substance of the communication.

CITY COUNCIL PUBLIC HEARING

a.
Consider this Administrative Report, testimony from members of the public, staff, and the information previously presented in staff reports and hearing minutes from the City Council meeting of August 8, 2005.

b.
Adopt the draft City Council resolution certifying that the City Council has reviewed and considered the information contained in the Final Supplemental Environmental Impact Report (Final SEIR) prepared for the 2005 Ventura General Plan, making findings pursuant to Section 15091 of the California Environmental Quality Act (CEQA) Guidelines, and adopting a  Statement of Overriding Consideration pursuant to Section 15093 of the CEQA Guidelines.

c.
Adopt a City Council Resolution re -adopting the Predicted Development Intensity and Pattern estimates (Table 3 -2) of the 2005 Ventura General Plan.  The proposed action is recommended subject to and based upon the record of this hearing, including without limitation this administrative report.

d.
Direct staff to file a Notice of Determination to document certification of the Final Supplemental Environmental Impact Report for the project.
